Bosnia and Herzegovina: Stop extradition Musaed Al Musailim who is at risk of torture or ill-treatment to Kuwaiti authorities

The International Council for Supporting Fair Trial and Human Rights was directly aware of the judicial procedures against Al-Musailim, who was subjected to an unfair and politicized trial that ended with the Public Prosecutor claiming that it is a full-fledged case that should be deported to his country, Kuwait, despite clear indications that the charges against him are malicious and devoid of evidence.

The authorities in Bosnia and Herzegovina should be aware that returning a Muslim to his homeland, Kuwait, would expose him to the risk of torture or other cruel, inhuman or degrading treatment or punishment, as well as arbitrary detention, and would be a direct partner in this human crime. Therefore, we urge the authorities to protect Mr. Al-Musailim's rights and not to expel, return, or extradite him to the Kuwaiti authorities and to immediately conduct a detailed and individual risk assessment with the aim of ensuring full respect for their obligations under international human rights law, humanitarian law and refugee law and granting him political asylum due to his need for immediate protection.

The ICSFT calls on the relevant bodies of the United Nations, especially the United Nations High Commissioner for Refugees (UNHCR), to immediately intervene to stop the delivery of Musaed Al Musailim to the Kuwaiti authorities and to oblige the authorities in Bosnia and Herzegovina to carry out their legal duties by granting him the right to asylum, as he is under direct threat due to his political views. And to intervene with the INTERPOL to cancel the red card, because the wanted victim was one of the victims who were persecuted in his homeland, being an opposition political activist and expressing his opinion.

The ICSFT also calls on the Kuwaiti authorities to stop targeting human rights activists and dissidents and to issue harsh sentences against them through laws that violate international legitimacy.
